Article 1: Definitions
In these terms and conditions, the following terms are used:
Article 2: Applicability
These terms and conditions apply to all auctions, transactions, and services offered by HorseBidder.
By using the platform, both the Seller and Buyer accept these terms.
Deviations from these terms are only valid if agreed upon in writing with HorseBidder.
Article 3: Auction Terms
The Seller registers a horse via the registration form on the website and must provide correct information, videos, photos, and x-rays of the horse.
The horse will be assessed by HorseBidder before being allowed into the auction.
The Seller sets a minimum price. If the bid does not reach this price, the horse will not be sold, and no fees will be charged to the Seller.
The Buyer pays a 5% commission (excluding VAT) on the purchase price to HorseBidder.
The auction ends on a set date and time. The highest bid above the minimum price results in the sale.
Article 4: Payment
The Buyer must pay the full purchase price, including any VAT, within seven (7) days after the auction ends to the Seller.
The Buyer must pay the 5% commission (excluding VAT) to HorseBidder within the same period.
The horse will only be transferred after both the full payment to the Seller and the commission to HorseBidder have been received.
Article 5: Delivery and Transfer of Ownership
The Seller and Buyer make arrangements for the transfer of the horse.
The transfer will only occur after the full payment has been received.
HorseBidder is not a party to the actual delivery and holds no responsibility for it.
Article 6: Liability and Warranty
The Seller guarantees that all information provided about the horse is correct and complete.
HorseBidder is not responsible for incorrect or misleading information provided by the Seller.
HorseBidder is not liable for any damage arising from the sale and delivery of the horse.
Article 7: Cancellation and Sale Outside the Auction
A Seller wishing to sell the horse outside the auction must discuss this with HorseBidder beforehand.
If a horse is no longer available for the auction after registration, the Seller must inform HorseBidder immediately.
Article 8: Disputes and Applicable Law
These terms and conditions and all agreements made through HorseBidder are governed by Belgian law.
Disputes arising from the agreement or these terms will be submitted to the competent court in Antwerp.
Article 9: Changes to the Terms and Conditions
HorseBidder reserves the right to modify these terms and conditions at any time.
Changes will be communicated through the website and take effect immediately for new auctions and agreements.
